What I'm going to do is talk about neuroscience and how it may impact justice. I had to give a talk recently to judges and lawyers, but it really is the same talk you would give anybody. It is a summary of four years of effort that I've put into this MacArthur Law and Neuroscience project.


How that came about is there was a meeting in New York of lawyers, philosophers, neuroscientists, and psychologists. They met four or five years ago to talk about whether one should study the topic of law and neuroscience. I left the room to go to the bathroom or something, I came back and they said, okay, you're directing it. So don't leave the room when these things are going on because you get saddled with surprises!

Since "basic neuroscience for judges and lawyers" was exactly the wrong talk for you at 3:00 o'clock this afternoon, let's say "perspectives on basic neuroscience" because the former one reminds you of your high school biology class which most of you probably didn't like.

I'm going to give you the fastest three-minute review of neuroscience. As I said I just gave to the judges of the Second Circuit Court of New York.  Many of you maybe have cases in front of the Second Circuit, and they have a retreat every year up at Lake Sagamore , New York. The idea is: You can't, obviously, for someone who's not in neuroscience, you can't communicate the wealth of neuroscience in a hundred lectures, let alone one, let alone a few minutes. But you can kind of get a feel for it.

I want to take you through that feel and then take that into the question of how is this field of neuroscience going to impact how we think about the law and, more importantly, how we think about justice.



Don’t Blink! The Hazards of Confidence. Daniel Kahneman

Many decades ago I spent what seemed like a great deal of time under a scorching sun, watching groups of sweaty soldiers as they solved a problem. I was doing my national service in the Israeli Army at the time. I had completed an undergraduate degree in psychology, and after a year as an infantry officer, I was assigned to the army’s Psychology Branch, where one of my occasional duties was to help evaluate candidates for officer training. We used methods that were developed by the British Army in World War II.

One test, called the leaderless group challenge, was conducted on an obstacle field. Eight candidates, strangers to one another, with all insignia of rank removed and only numbered tags to identify them, were instructed to lift a long log from the ground and haul it to a wall about six feet high. There, they were told that the entire group had to get to the other side of the wall without the log touching either the ground or the wall, and without anyone touching the wall. If any of these things happened, they were to acknowledge it and start again.

A common solution was for several men to reach the other side by crawling along the log as the other men held it up at an angle, like a giant fishing rod. Then one man would climb onto another’s shoulder and tip the log to the far side. The last two men would then have to jump up at the log, now suspended from the other side by those who had made it over, shinny their way along its length and then leap down safely once they crossed the wall. Failure was common at this point, which required starting over.

Medio año después del accidente nuclear de Fukushima el programa de rehabilitación iniciado por las autoridades japonesas apunta resultados prometedores. El director técnico de Protección Radiológica del Consejo de Seguridad Nuclear (CSN), Juan Carlos Lentijo, ha liderado la segunda misión internacional enviada a Japón por el Organismo Internacional de Energía Atómica (OIEA) y ha constatado que el programa japonés para la recuperación de las zonas afectadas por el accidente de Fukushima es "serio", "solvente" y se están tomando las "medidas adecuadas".
Para entender cómo están evolucionando las consecuencias del accidente, y cómo pretende combatirlas el gobierno japonés, conviene echar una mirada al mapa elaborado por medios aéreos por estadounidenses y japoneses hace unos meses en el que se registran los distintos niveles de contaminación.

Banca, pagos y finanzas. Francisco Capella

Un banco puede realizar para sus clientes diversas funciones que pueden ser agrupadas en dos grandes categorías: gestión de cobros y pagos, e intermediación financiera. Un banco puede además prestar servicios adicionales como cambio de divisas o cajas de seguridad.

A grandes rasgos la banca comercial realiza operaciones de cobros y pagos, y la banca de inversión (o industrial) se dedica a la intermediación financiera o gestión del ahorro y la inversión; pero estos límites y denominaciones no son rígidos, drásticos o absolutos y pueden depender del marco legal de cada país.

Un cliente abre una cuenta corriente en un banco y con ella puede realizar ingresos y retiradas, cobros y pagos: utilizar billetes (si el banco los emite) o depósitos a la vista como medios de pago; domiciliar nóminas y recibos; realizar transferencias o giros; emplear cheques; utilizar tarjetas de débito y crédito (si el pago se aplaza durante un tiempo largo se convierte en un asunto financiero).

En la intermediación financiera el banco por un lado obtiene fondos prestados por un plazo determinado (ahorro) y por otro los presta o invierte (compra de acciones o deuda ajena por el propio banco); además puede ofrecer garantías, avales, cartas de crédito, y distribuir o colocar productos financieros ajenos (acciones, bonos).

Los ingresos y potenciales beneficios del banco pueden proceder de comisiones por operación (o  por mantenimiento de cuentas) y de márgenes de intermediación financiera (el tipo de interés al que el banco presta es mayor del que paga por recibir fondos prestados).

Is self-knowledge overrated? Jonah Lehrer

Daniel Kahneman, a Nobel Prize-winning psychologist and the author of the new book “Thinking, Fast and Slow,” changed the way people think about thinking by asking them questions. They weren’t trick questions, either. Instead, Kahneman relied almost exclusively on straightforward surveys, in which he described various scenarios. Here’s a sample:

The U.S. is preparing for the outbreak of an unusual Asian disease, which is expected to kill 600 people. Two alternative programs to combat the disease have been proposed. If program A is adopted, 200 people will be saved. If program B is adopted, there is a one-third probability that 600 people will be saved and a two-thirds probability that no people will be saved. Which of the two programs would you favor?

When Kahneman put this question to a few hundred physicians, seventy-two per cent chose option A, the safe-and-sure strategy. Most doctors would rather save a certain number of people for sure than risk the possibility that everyone might die.

Now consider this scenario:

The U.S. is preparing for the outbreak of an unusual Asian disease, which is expected to kill 600 people. Two alternative programs to combat the disease have been proposed. If program C is adopted, 400 people will die. If program D is adopted, there is a one-third probability that nobody will die and a two-thirds probability that 600 people will die. Which of the two programs would you favor?

The two different hypotheticals, of course, examine identical dilemmas: saving one-third of the population is the same as losing two-thirds. And yet, doctors reacted very differently depending on how the question was framed. When the possible outcomes were stated in terms of deaths (and not survivors), physicians were suddenly eager to take chances: seventy-eight per cent chose option D.

Thomas Babington Macaulay's remarks, in the Edinburgh Review, that I often quote –

"We cannot absolutely prove that those are in error who tell us that society has reached a turning point, that we have seen our best days. But so said all before us, and with just as much apparent reason ... On what principle is it that, when we see nothing but improvement behind us, we are to expect nothing but deterioration before us"

This alerted me to the startling fact that even 200 years ago, when human living standards had barely begun to improve, intellectuals were already lamenting the imminent and inevitable end of that improvement. They were wrong then and they are wrong now.

El pasado 26 de octubre, la Condit Dam, fue demolida con el fin de restablecer el cauce fluvial, y con ello la flora y fauna, que durante muchos años ha supuesto la interrupción del canal del salmón. Resulta espectacular el desagüe del agua con los limos depositados en la represa.
For 98 years, the 125-foot high Condit Dam in southeastern Washington State held back the White Salmon River, creating a serene lake, but choking off the waterway to salmon. Wednesday, in an historic effort, the dam was dramatically breached, and ecologists hope the increased flow of water will restore the waterway to fish and other aquatic organisms, as well as the birds and mammals that rely on them.

Hoy me llega  una peculiar denuncia sobre la represión contra las Damas de Blanco en La Habana. Ya sé,  pensarán "eso no es noticia". Sin embargo, hay algo novedoso en esta información que evidencia que los sicarios cubanos están perdiendo los estribos. (Normal dirán algunos, tras el violento fin por ajusticiamiento popular de uno de sus principales secuaces en el mundo árabe: el Gadhafi).

He aquí un ejemplo del recrudecimieto de la brutalidad policial en estos días en nuestra Cuba. En la mañana de hoy la seguridad del estado intentó arrestar violentamente a la bloguera y activista Katia Sonia Martín Véliz —miembro de las Damas de Blanco y de la junta directiva del Partido Cuba Independiente y Democrática (CID)—.

Como cada domingo, Katia Sonia se preparaba para asistir a la misa en la iglesia de Santa Rita junto a sus colegas de las Damas de Blanco y Apoyo. Pero hoy Katia iba acompañada de sus dos pequeñas hijas, las gemelas Samantha de la Caridad y Samyra de la Caridad Medina Martín. 

Grande fue su sorpresa al salir a la calle cuando agentes de la policía política se le abalanzaron encima e intentaron arrestarla violentamente sin tener en cuenta la presencia de las dos niñas que aterrorizadas gritaban y lloraban para que no le hicieran daño a su madre.

Las elecciones en Túnez son un éxito aunque ganen los islamistas. Jordi Pérez Colomé


Las elecciones en Túnez han sido un éxito. Ha habido pocas quejas de irregularidades, los partidos principales aceptan los resultados y los observadores internaciones dicen que les han parecido perfectas: “He vigilado 59 elecciones en 15 años, muchas en viejas democracias y nunca había visto un país capaz de llevar a cabo unos comicios en un modo tan justo, libre y digno”, dice un parlamentario suizo.

No solo eso. La ley electoral tunecina obligaba a los partidos a intercalar en sus listas hombres y mujeres. Aunque el primero sea casi siempre un hombre, la nueva asamblea será bastante paritaria. Aquí han calculado lo que puede salir: 56 por ciento de hombres, 44 de mujeres. En España hay un 36 por ciento de mujeres en el Congreso; en Estados Unidos, un 17.

Túnez escoge en estas elecciones una asamblea constituyente que debe hacer dos cosas. Primero y más importante, redactar toda una constitución: escoger por ejemplo si quieren un sistema parlamentario o presidencial o si van a cambiar el artículo 1, que dice que “la religión de Túnez es el islam, su lengua él árabe y su forma la república” (es poco probable que se metan en estos líos). Segundo, nombrar un gobierno interino para que dirija el país, con presidente y primer ministro. Este proceso debe durar un año. Entonces habrá quizá referéndum para confirmar la constitución y elecciones con reglas nuevas.

Syrian forces kill 40 as Arab League denounces attack. Jo Adetunji

Syrian security forces opened fire on protesters following Friday afternoon prayers, killing at least 40 civilians, according to activists.
After what was one of the bloodiest days in seven months of protests, Arab ministers sent their strongest message yet calling for an end to civilian killings.

The Arab League's committee on the Syrian crisis said it had sent an "urgent message ... to the Syrian government expressing its severe discontent for the continued killing of Syrian civilians".
The committee said in a statement it had "expressed the hope that the Syrian government would take action to protect civilians".
Forces acting for President Bashar al-Assad were reported to have chased protesters and conducted house-to-house raids following the end of prayers in the central cities of Hama and Homs, which have seen an emerging armed insurgency.
One activist, Mustafa Osso, told the Associated Press that Syrian forces opened fire on as many as 2,000 people who had gathered to protest. "There was a very fierce reaction to the protests in Homs. There are many injured as well. Hospitals are having a hard time coping with the casualties," he said.
It is believed there were at least 170 separate protests across the country. An 80-year-old man was reportedly shot near Homs and a young boy in the south-western city of Deraa, but there were conflicting reports over the details.

Maite Pagaza es una mujer admirable. Te lo he dicho y escrito decenas de veces. Las razones son múltiples, pero ahora sobresale una: ha conseguido que su condición de víctima del terrorismo sea marginal. En el espacio público Maite Pagaza ya no es la dama consorte de la muerte, sino una mujer intelectualmente enfrentada al complejo asunto moral de la convivencia entre asesinos y víctimas en el próximo País Vasco. Entre sus últimos trabajos, como presidenta de la Fundación de Víctimas del Terrorismo, está un documental que se presentó el miércoles en Madrid. El 27 de marzo de 2011, nueve personas se reunieron para debatir el Documento de la Justicia que la Fundación había elaborado semanas antes. El encuentro fue filmado íntegramente. Manifiesto para un final se llama. Extremadamente sobrio y de gran interés. La asociación quiere organizar proyecciones en toda España y tejer una trama de debates. Para pellizcar el músculo moral de la sociedad española. Será necesario. El Estado ha derrotado a ETA. Ahora habrá que escribir la crónica. Yo recomiendo consultar a los franquistas, si queda alguno, porque entienden mucho de este asunto; ellos que ganaron la guerra pero permitieron que sus enemigos la escribieran.
  

Hace algún tiempo escribí que lo peor de exigir el perdón a los etarras es que habríamos de dárselo. Porque, en efecto, no se concibe una circunstancia de penitencia unilateral, no correspondida. No sé qué opinarán las víctimas que aparecían en el documental de mi querida Pagaza. Víctimas hay de muchos pareceres. Es esta humanidad plural la que las diferencia, y muy precisamente, de sus asesinos. Yo me atrevo a pedirle a Antonio Recio que revise la jurisprudencia del perdón. Sobre todo para que las víctimas españolas, como hicieron desde el primer muerto, puedan seguir acogiéndose cada día del resto de sus vidas al imperativo legal. Y que así, desde su más estricta observancia, perdonen. Las que puedan perdonar y las que no.
